Questions of Intent and Jurisdiction Put an End to Spanish War Crimes Probe
"Halted just a month after it began, an effort to investigate more than 130,000 Spaniards who disappeared under the authority of former dictator Francisco Franco has again cast a light on the divisive issue of war crimes in Spain."

Over 130,000 Spaniards disappeared during the reign of Spanish dictator Francisco Franco. Judge Baltasar Garzon described Franco's efforts to eliminate all opposition during the Spanish Civil War and the years that followed. For nearly four decades from 1939 to 1976, Franco ruled Spain as a fascist dictatorship. Garzon says Franco's elimination of the opposition constitutes a war crime under international law. Surviving accomplices of Franco do not qualify for amnesty and can still be prosecuted. A month later, Garzon said the crimes are not under his jurisdiction.

Civil War Legacy Divides Spain
Francisco Franco started a civil war in Spain more than 70 years ago as his fascist military rose up against a democratic government. After the war, he ruled Spain for forty years. Spain seems to suffer from amnesia when it comes to the war. More than a third of the Spaniards surveyed didn't learn about it in school. There are disputes about the causes of the war and the best way to deal with the consequences. Some saw it as a fight against communism or fascism. Some want to leave it alone while others want to help the victims.
